How Powers of Attorney Work

When a durable power of attorney is established, legal decision-making rights are assigned to a person of your choice. One person – the principal – gives someone else – the agent – the right to make choices if the principal is incapacitated due to age, injury, or illness.

One of the advantages of a power of attorney is that it can be customized to your unique situation. You may choose to allow your agent to handle all your affairs or to make decisions for you only in specific situations.

A power of attorney agent can be given the right to make decisions regarding:

  • Disposal of property — homes, cars, etc.
  • End-of-life health care
  • Signing contracts
  • Granting access to bank accounts
  • Other legal decisions

The agent is typically a trusted friend or family member, often a spouse, sibling, or child. You may even choose multiple people to be agents for you — one person to make financial decisions and another person to make medical ones, for example. The power of attorney itself should be drawn up by a lawyer once you have selected your agent(s). A power of attorney must be witnessed and notarized to be valid in Florida.

Be Prepared

Many seniors choose to create a power of attorney in case of deteriorating health or diminished capacity later in life. However, a medical emergency can happen to anybody, regardless of age. It is always better to have a plan in place before it’s needed. Even if you do not have a health condition requiring a power of attorney in the future, you should be prepared. Fort Lauderdale attorney Wendy Rivera can assist you.
